Peloton Membership Terms

By purchasing or using a Peloton Membership, you agree to the following terms and conditions, which supplement and form a part of the Peloton Terms of Service. Capitalised terms not defined here have the meaning given to them in the Peloton Terms of Service.

Important: These Membership Terms include an agreement to acquire services for a term that will automatically renew. Please read the Membership Terms carefully for information about what you must do if you do not wish the term to automatically renew.

The provisions of these Membership Terms must be read subject to any applicable Australian laws, including the Australian Consumer Law. Under the Australian Consumer Law, there are certain consumer guarantees which cannot be excluded, restricted, or modified except to a limited extent.

A “Member” is any individual who has a Peloton account for personal, non-commercial use, excluding individuals with a Peloton Free membership account. A “Membership Owner” is any Member who activates and pays the subscription fees for a Membership. A “Membership” is either a Peloton All-Access Membership, Guide Membership an App Membership, as defined below.

1. Membership Types and Billing Cycles

Membership Types. All-Access Membership. An “All-Access Membership” may be purchased or received in connection with a Peloton connected fitness product, such as the Peloton Bike, Bike+ or Tread (each, a “Peloton Product”).An All-Access Membership provides you and members of your household at one residential address (up to 20 user profiles), with full access to Peloton’s available classes, content, and features on one respective Peloton Product from each Peloton Product category (e.g., one All-Access Membership may be attached to a Peloton Bike, Tread and/or Guide at the same household, but not a Peloton Bike and a Peloton Bike+ at the same household), plus access to all available classes, content, and features on the Peloton Guide and Peloton App, for as long as the All-Access Membership remains active. All-Access Members will only have access to the features and content made available on respective Peloton Products that they are using (e.g., Peloton Lanebreak is currently only available for use on Bike and Bike+).

Guide Membership. A “Guide Membership” provides you and members of your household at one residential address (up to 5 user profiles) with access to Peloton’s available classes, content, and features on the Peloton Guide, plus access to all available classes, content, and features on the Peloton App, for as long as the Guide Membership remains active. A Guide Membership does not provide access to any classes, content, and features on any Peloton Product other than the Peloton Guide.

App Membership. An App Membership provides you (1 user profile) with access to available classes, content, and features on the Peloton App. An App Membership does not provide you with access to any classes, content, and features on any Peloton Products or the Peloton Guide. An App Membership can be purchased from Peloton or via an app provider where Peloton makes the Peloton App available (e.g., Apple App Store or Google Play Store). Each of the Membership types is sold separately. As a Membership Owner, you may possess one or more Memberships. We may impose restrictions on the number of streams that can occur simultaneously under a single Membership or the maximum number of users per Membership. The Membership Owner is responsible for all activity under their Membership.

Billing Cycles and Auto-Renewal. IMPORTANT: Any Membership recurs on a monthly (for a monthly membership) or annual (for an annual membership) basis ("Billing Cycle") until it is cancelled in accordance with these Membership Terms.

When you purchase a Membership, you agree to pay Peloton a recurring fee. You are responsible for paying all recurring fees incurred under your Membership, as described in section 4 of these Membership Terms. Your Billing Cycle commences on your billing date ("Billing Day") and provides access for one month (for a monthly membership) or for one year (for an annual membership) thereafter. Your Billing Cycle expires at midnight on the day prior to your Billing Day in the subsequent month or one year period (as applicable). Unless you choose to cancel your Membership, it will automatically renew at the end of your Billing Cycle for a further Billing Cycle. If you do not want your Membership to automatically renew, you must cancel your Membership in accordance with section 3 of these Membership Terms. Other Offers. Peloton may offer additional promotions or discounts related to Memberships from time to time. Please read the details of those offers carefully, as any additional terms presented to you during the signup process will form part of these Membership Terms. Unless specified in writing, all discount offers that require a payment (including but not limited to annual Peloton membership) are non-refundable, except as required by the consumer guarantees under the Australian Consumer Law. Any trial or other promotion must be used within the specified time frame of the trial or promotion. You may be required to have a valid payment method on file in order to initiate a trial; in this case, if you do not cancel at any time before your trial period ends, your account will be converted to a paid Membership and will be charged in accordance with these Membership Terms.

2. Account Registration

Account Registration. You can register by successfully completing a Peloton purchase, or by creating an account on the Peloton Site, a Peloton App, or a Peloton Product, as further described in our Terms of Service. All information that you provide must be accurate, including your name, address, credit, debit or charge card numbers and expiration dates, and any other payment information. You are responsible for keeping such information up-to-date and must provide changes promptly to your account page, which may be accessed at https://members.onepeloton.com.au/preferences/profile-info. Peloton’s use of your information is governed by our Privacy Policy. YOU MUST PROMPTLY NOTIFY US OR OUR PAYMENT PROCESSORS IF YOUR PAYMENT METHOD IS CANCELLED (E.G., FOR LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORISED DISCLOSURE OR USE OF YOUR USERNAME OR PASSWORD.

Any individual who creates an account on the Peloton App but does not purchase a Membership and is not included under the account of a Membership Owner shall comply with Peloton’s Terms of Service and Community Guidelines as if they were a “Member” under such agreements and is subject to Section 3 “Suspension/Termination by Peloton” below as if they were a “Member.”

3. Termination or Cancellation of Subscription

Cancellation of Membership. If you terminate your Membership, you may use your Membership until the end of the then-current Billing Cycle, and your Membership will not be renewed after that Billing Cycle expires. However, you will not be eligible for a prorated refund of any portion of the Membership fee paid for the then-current Billing Cycle, subject to the below.

If you terminate your Membership because Peloton has made a material change to the Peloton Terms of Service that detrimentally affects your rights under the Terms of Service or because Peloton makes a change to the Peloton Service that materially detrimentally affects members, in the period within 30 days of Peloton providing notice to you of relevant changes, Peloton will provide a pro-rata refund of any portion of the Membership fee paid for the Billing Cycle current as at your termination date.

This provision does not purport to limit liability or alter your rights as a consumer that cannot be excluded or limited under applicable law, including any of the non-excludable requirements of the Australian Consumer Law. To terminate your Membership, go to your Account Settings at https://members.onepeloton.com.au/preferences/subscriptions or contact Member Support at 1800 952 535. Suspension/Termination by Peloton. Peloton may immediately terminate or suspend your account, and all or a portion of your Membership, without notice if:

  • your payment is overdue (provided that we will use reasonable efforts to notify you of the overdue payment before we terminate or suspend);
  • you provide false or inaccurate information;
  • you violate these Membership Terms, the Terms of Service or any other Peloton rules or agreements then in effect;
  • you engage in conduct that is a violation of any applicable law or tariff (including, without limitation, copyright and intellectual property laws); or
  • if you engage in conduct that is threatening, abusive or harassing to Peloton employees, agents, or other Peloton users, including, for example, making threats to physically harm or damage property.

In the event that Peloton determines, acting reasonably, that your Membership is being accessed in a commercial setting or is for commercial use, Peloton may either (i) immediately terminate or suspend your Membership by writing to you at the email address associated with your Membership; or (ii) allow you to convert your Membership to a commercial subscription subject to the Peloton’s commercial terms & conditions (which are available on request). You understand and agree that conversion of a Membership to a commercial subscription may be subject to additional fees and requirements as provided to you by Peloton.

If we terminate or suspend your Membership or access to the Peloton App, your license to use any software or content provided in connection with the Membership or access to the Peloton App is also terminated or suspended (as applicable). If your Membership or access to the Peloton App is terminated, Peloton has the right to immediately delete all data, files, and other information stored in or for your account without further notice to you. You must pay all charges up to and including the date of termination. Should you wish to resume your Membership after any suspension, a restoration of service fee may apply. This fee is in addition to all past due unpaid charges and other fees.

4. Payment

Amount to be Charged. Membership Owners agree to pay the recurring fee specified when you purchased your Membership . If the recurring fee increases from the amount specified when you purchased your Membership we will provide you at least 30 days' written notice by email, on the Peloton Site and/or through the Peloton Service and, if required by applicable laws, seek your express consent to the change in price. All changes will be effective after the 30 day notice period, upon commencement of your next Billing Cycle. You can avoid these changes by cancelling your Membership at any time prior to the commencement of your next Billing Cycle in accordance with section 3 of these Membership Terms.

Any agreement you have with your payment provider governs your use of your specified payment method. You agree that we may accumulate charges incurred and submit them as one or more aggregate charges during or at the end of each billing cycle. Your failure to terminate and/or continued use of your Membership reaffirms that we are authorised to charge you for that Membership. We may submit those charges for payment and you will be responsible for such charges. This does not waive our right to seek payment directly from you.

Billing Authorisation. You may be asked to provide a payment method (such as a credit, charge or debit card number) that we accept in order to activate your Membership, along with other payment information. You represent and warrant that you have the legal right to use all payment method(s) that you provide to us. Your authorisations in this section also apply to our payment processors and any other companies who act as billing agents for us. You hereby authorise us to charge your specified payment method on a monthly or annual basis, as applicable, in line with your Billing Cycle, in advance, for your Membership(s) and/or to place a hold on your payment method with respect to any unpaid charges for your Membership(s). You authorise the issuer of your selected payment method to pay any amounts described herein without requiring a signed receipt, and you agree that these Membership Terms shall be accepted as authorization to the issuer of the payment method to pay any amounts described herein, without requiring a signed receipt from you. You authorise us to continue to attempt to charge and/or place holds with respect to all sums described herein, or any portion thereof, to your payment method until such amounts are paid in full. You agree to provide updated payment information upon request and any time the information you previously provided is no longer valid. You acknowledge and agree that neither Peloton, nor any Peloton agent, will have any liability whatsoever for any insufficient funds or other charges incurred by you as a result of attempts to charge, and/or place holds on, your specified payment method as contemplated by these Membership Terms. If you provide a debit card number instead of a credit card number, you authorise all charges described herein to be applied to such debit card unless and until you provide a credit card number.

Third-Party Payment Processors. You agree to pay us, through our payment processors or financing partners (as applicable), all charges at the prices then in effect for any purchase in accordance with the applicable payment terms presented to you at the time of purchase. You agree to make payment using the payment method you provide when you set up your account. We reserve the right to correct, or to instruct our payment processors or financing partners to correct, any errors or mistakes, even if payment has already been requested or received.

Financed Purchases. If you finance the purchase of your Membership, you agree to abide by the terms of the financing agreement with our financing partner governing your purchase, which will be provided to you separately. Peloton may treat your failure to abide by the terms of your financing agreement with our financing partner as a breach of these Membership Terms.

Bill Inquiries and Refunds. If you believe you have been billed in error for a Membership, please notify us within 60 days of the billing date by contacting Member Support at 1800 952 535 or emailing support@onepeloton.com.au. Peloton will not issue refunds or credits after the expiration of this 60-day period, except where required by applicable law.
